GENERAL TERMS AND CONDITIONS OF SALE
Preamble
The present General Terms and Conditions of Sale are concluded between, on the one hand
SAS Wilma Group (hereafter referred to as Wilma Group), a company with a capital of €5000

and, on the other hand, any person wishing to place an order for the sale of clothing (hereinafter referred to as "Customers") through the website "www.wilma.cc", exclusive property of the Wilma Group.

Article 1 - Purpose
Governed by Article L. 441-6 of the French Commercial Code and in accordance with Article L.111-1 of the French Consumer Code, the present General Terms and Conditions of Sale govern the sale of any product presented on the website www.wilma.cc by the Wilma Group. They aim to define the reciprocal obligations of the parties as well as the different stages of the order process.
By validating an order on the website, the customer declares that he/she has read, understood and accepted without reservation the terms of the said order as well as the entirety of these General Terms of Sale.
These conditions may be subject to change. Therefore, it is understood that the applicable conditions are those in force on the site at the time the contract is placed.
Article 2 - Legal capacity
Customers declare that they are of legal age and fully capable of contracting.
Article 3 - Geographical areas
The products and services are offered only in Europe. Sales outside these geographical areas cannot be taken into account for logistical reasons.
Article 4 - Prices of products on sale
The prices indicated on the www.wilma.cc website are in euros, including VAT. VAT is applied at the rate in force in metropolitan France at the time of the order. The selling prices of the products may be modified at any time by Wilma Group. Any change in the rate will be applied immediately to the order in progress.
Article 5 - Articles and products
The articles visible on the www.wilma.cc website can only be delivered while stocks last. If the product is not available, the Wilma Group undertakes to inform the buyer as soon as possible by e-mail or telephone. The buyer will then have the option of choosing another article or cancelling the order and receiving a refund.
Wilma Group endeavours to describe the products offered for sale as accurately as possible. The customer has the opportunity to view the essential characteristics of the products he/she intends to purchase on the Wilma website prior to placing an order. However, the Wilma Group cannot be held responsible for any errors in this presentation. The illustrations and photos of the products that support the text are not contractually binding. The Wilma Group cannot be held responsible for these illustrations/photographs under any circumstances.
Article 6 - Orders
As soon as the Customer definitively validates their order by clicking on "Validate your payment", it is established that they knowingly accept the content, delivery terms and conditions of the Order in question and above all these General Terms and Conditions of Sale, the prices, quantities, descriptions, characteristics, volumes and delivery times of the products ordered by the Customer on the Site.
Wilma Group will acknowledge receipt of this order by sending an email to the Customer who placed the order. The Wilma Group reserves the right to cancel or suspend the execution of an Order or its delivery, regardless of its nature and stage of execution, in the event of an inability to debit the Customer's bank account for the order or any sum due by the Customer, or in the event of a payment incident, or in the event of fraud or attempted fraud relating to the use of the Wilma Group Website, including in the case of previous orders. Finally, the Wilma Group cannot be held responsible if the email address provided by the Customer at the time of registration is incorrect and if the Customer has not received the order confirmation email sent systematically by the Wilma Group. The sale will then be considered definitive, unless Wilma Group deliberately decides to cancel it, for example in the event of the ordered products being out of stock. However, the customer may exercise their right of withdrawal within 15 days of the date of the order.
Article 7 - Payments
The Customer has the option of paying by credit card directly on the site, with a Visa, Eurocard or Mastercard. Payment methods such as bank transfer and cash on delivery are not accepted.
The invoice amount will be debited from the customer's account on the date of payment.

Article 8 - Delivery
1. Delivery areas
The delivery service only covers the following geographical area: European Union. Wilma Group is not yet in a position to offer its service in the French overseas departments and territories.
2. Terms of delivery
The pre-ordered products will be delivered to the address given in the "My Account" information form filled in by the Customer when registering. In the event of a change of address, it is the Customer's responsibility to notify this before placing the order by modifying their details on the "My Account" information form.
For all products (excluding pre-orders), delivery will be ensured at the latest 15 days after validation of the order (if the product(s) are available in stock). The customer is delivered to a collection point or to his home depending on his choice at the time of payment.
Article 9 - Returns
Our policy lasts 30 days. If 30 days have elapsed since your purchase, we unfortunately cannot offer you a refund or an exchange.
To be eligible for a return, your item must be unused and in the same condition as you received it. It must also be in its original packaging.
Several types of products cannot be returned: gift cards, credit cards, debit cards and credit cards.
To complete your return, we need a receipt or proof of purchase.
Please do not return your purchase to the manufacturer.
In certain situations, only partial refunds will be given (where applicable)
- any item that is not in its original condition, is damaged or is missing parts for reasons not caused by our error
- any item returned more than 30 days after delivery.
Refunds (if any)
Once we have received and inspected your return, we will send you an email to inform you that we have received your returned item. We will also inform you whether your refund has been approved or rejected.
If your refund is approved, it will be processed and a credit will automatically be applied to your credit card or original payment method within a few days.
Late or missing refunds (if applicable)
If you have not yet received a refund, first check your bank account again.
Then contact your credit card company. It may take some time for your refund to be officially recorded.
Then contact your bank. There is often a processing time before the refund is posted.

Exchanges (where applicable)
We will only replace items if they are faulty or damaged. If you wish to exchange it for the same item, please email us at hello@wilma.cc and send your item to Groupe Wilma, 66 rue Cuvier 69006 Lyon, France.
Gifts
If the item was marked as a gift at the time of purchase and shipped directly to you, you will receive a gift credit for the value of your return. Upon receipt of the returned item, a gift certificate will be sent to you by mail.
If the item was not marked as a gift at the time of purchase, or if the gift recipient had the order shipped to you later, we will send a refund to the gift recipient and they will be notified of your return.
Shipping
To return your product, you must send it by post to the following address: Wilma Group, 66 rue Cuvier 69006 Lyon, France
You will be responsible for paying your own shipping costs for the return of your item if you live outside of France. Shipping costs are not refundable. If you receive a refund, the return shipping costs will be deducted from your refund.
The delivery time of your exchanged product may vary depending on your place of residence.
Article 10 - Rights and time limits for withdrawal
From the date of receipt of the order, the Customer has a period of fifteen (15) days to return the products ordered. All returns of products will be made to the address mentioned in the previous article. When the right of withdrawal is exercised, a maximum period of thirty (30) days is necessary from the receipt of the returned product to Wilma Group, before the amount of the returned product(s) is credited back to the account corresponding to the Customer's credit card.
Article 11 - Legal guarantees
The products sold are covered by the legal guarantee of conformity provided by articles 211-4 and following of the Consumer Code and the guarantee of hidden defects (articles 1641 and following of the Civil Code). These guarantees cover hidden defects and visible defects from the date of delivery. The only obligation incumbent on Circle Sportswear under this guarantee is, at its choice, the free replacement or repair of the products recognised as defective without any other service or compensation.
This warranty does not apply to damage resulting from improper use of the product, normal wear and tear due to its use or failure to follow washing and maintenance instructions. In order to benefit from the product guarantee, it is essential to keep the purchase invoice for the product as well as the delivery note.

Article 13 - Confidentiality
This privacy policy describes how your personal information is collected, used and shared when you visit or make a purchase from www.wilma.cc.
Personal information we collect.
When you visit the Site, we automatically collect certain information from your device, including information about your web browser, your IP address, your time zone and some of the cookies installed on your device. In addition, as you browse the Site, we collect information about the individual web pages or products you view, the websites or search terms that referred you to the Site and how you interact with the Site. We refer to this automatically collected information as "Device Information".
We collect Device Information using the following technologies:
- "Cookies" which are data files that are placed on your device or computer and often include an anonymous unique identifier. For more information about cookies and how to disable them, visit http://www.allaboutcookies.org.
- "Log files" track actions that occur on the Site and collect data, including your IP address, browser type, Internet service provider, landing/exit pages.
- Web beacons", "tags" and "pixels" are electronic files used to record information about how you browse the Site.
Article 14 - Liability
The Wilma Group cannot be held liable for any events, inconveniences or damage inherent in the use of the Internet network, particularly in the event of a breakdown in service, external intrusion or the presence of computer viruses.
Furthermore, the Wilma Group cannot be held responsible for the non-execution of the contract concluded in the event of a fortuitous situation, force majeure, disruption or total or partial strike, in particular of the postal services and means of transport and/or communications, flooding or fire. Wilma Group will not be held responsible for any indirect damage, operating loss, loss of profit, damage or expenses that may occur as a result of the present.
Article 15 - Jurisdiction
The present general conditions of sale are subject to French law. Any dispute which has not been resolved amicably shall be subject to the exclusive jurisdiction of the competent courts or the court of the place of actual delivery of the customer's order, notwithstanding multiple defendants and/or third party claims, even for emergency procedures or protective procedures in summary proceedings or by petition.
Article 16 - Intellectual property rights
The brands, domain names, products, software, images, videos, texts or more generally any information subject to intellectual property rights are and remain the exclusive property of Wilma Group.
No transfer of intellectual property rights is made through these GTC. Any total or partial reproduction, modification or use of these goods is strictly forbidden.
Article 17 - Amendment of the GTC
The Wilma Group reserves the right to modify the present General Terms and Conditions of Sale in any case. If the new General Terms and Conditions of Sale are not suitable for a customer, the latter must terminate his subscription by registered letter with acknowledgement of receipt before the new provisions come into force, in accordance with the terms and conditions set out in the Article "Right of withdrawal" of these General Terms and Conditions of Sale. The refusal of the new General Terms and Conditions of Sale must imperatively be explicit; without an explicit expression of will before the entry into force of the new provisions, the Customer will be deemed to have accepted the modifications.
